SO THE CITY'S LEGAL COUNSEL, AS I UNDERSTAND, SAYS THAT DUE TO THESE OLD DEVELOPMENT AGREEMENTS, THE CITY HAS A LEGAL OBLIGATION TO ALLOW MULTIFAMILY HOUSING TO BE BUILT ON THE WATERS PUD LAND. NOW AT THE SAME TIME, MOST RE RESIDENTS, IT SEEMS TO ME, DON'T WANT APARTMENTS TO BE BUILT ON THAT LAND. WELL, WE CAN DO BOTH. WE CAN FULFILL OUR LEGAL OBLIGATIONS BY CREATING A PUD THAT ALLOWS TOWN HOMES AND DUPLEXES, BUT NOT APARTMENTS. I BELIEVE MOST RESIDENTS WOULD VASTLY PREFER TOWN HOMES OR DUPLEXES TO APARTMENT COMPLEXES. I'VE READ THE DEVELOPMENT AGREEMENTS AND THERE'S NOTHING IN ANY OF THEM THAT SAYS MULTIFAMILY HAS TO MEAN APARTMENTS. THE KEY LANGUAGE SAYS COMMERCIAL SLASH MULTIFAMILY. THE CITY WOULD NOT BREACH ANY LEGAL OBLIGATION BY DISALLOWING APARTMENT COMPLEXES. SO LONG AS WE ALLOW OTHER FORMS OF MULTIFAMILY HOUSING AND OF COURSE, WHAT'S IN THE UTILITY AGREEMENTS DOES NOT AND CANNOT CONTROL OR OVERRIDE THE DEVELOPMENT AGREEMENTS. NOW, MAKING THAT CHANGE WILL REQUIRE SOME TIME CONSULTATION WITH COUNSEL, HAVE TO GO BACK AND RENEGOTIATE WITH THE LANDOWNER AND DEVELOPERS. I UNDERSTAND THAT. SO THAT MIGHT MEAN VOTING TO POSTPONE THE WATERS PUD TONIGHT AND COMING BACK TO IT NEXT MONTH. BUT MY ENCOURAGEMENT TO YOU IS TO TALK IT OVER WITH COUNSEL AND THINK IT THROUGH. THANK YOU.
